Summary
Xin (Selena) Li encouraged unlicensed activity by providing real estate services to an unlicensed brokerage and by paying remuneration to the unlicensed brokerage in the form of referral fees. By doing so, Ms. Li engaged in conduct unbecoming a licensee. Her actions contravened section35(2) of the Real Estate Services Act.
Ms. Li accepted 8 client referrals from an unlicensed brokerage. After the completion of each property sale, Ms. Li paid referral fees to the unlicensed brokerage. These actions contravened section 6-1(1) of the Council Rules.
Ms. Li provided real estate services other than on behalf of the brokerage in relation to which she was licensed when she provided real estate services on behalf of the unlicensed brokerage. This contravened section 7(3)(a) of the Real Estate Services Act.
Results
A discipline committee of the Council has ordered the following:
- Ms. Li's licence is suspended for a period of seven months from September 14, 2016 to April 13, 2017 inclusive.
- Ms. Li must pay a discipline penalty of $10,000.00 to the Council.
- At her own expense, Ms. Li must successfully complete the Real Estate Trading Services Remedial Education Course.
- Ms. Li must pay enforcement expenses of $1,500.00 to the Council.
