Summary
Peng (Sarah) Zhang, while licensed with New Coast Realty, neglected to include a clause in the Contract of Purchase and Sale for the buyers to receive and approve information or obtain independent professional advice about whether GST was applicable to their transaction. By not including the clause, Ms. Zhang failed to act with reasonable care and skill, failed to act in the best interest of her clients, and acted outside of her area of expertise, contrary to sections 3-4 and 3-3(a) and (d) of the Council Rules.
Results
A discipline committee of the Council has ordered the following:
- Peng (Sarah) Zhang is reprimanded.
- She must pay a discipline penalty of $2,500.00 to the Council.
- At her own expense, Ms. Zhang must successfully complete the Real Estate Trading Services Remedial Education Course.
- She must pay enforcement expenses of $1,500.00 to the Council.
As Ms. Zhang has a personal real estate corporation, these orders also apply to Sarah Zhang Personal Real Estate Corporation.
