ORDER FOR CONDITIONS UNDER SECTION 45(2) OF THE REAL ESTATE SERVICES ACT

Upon reading the Affidavits of Carmen deFoy, Compliance Officer, of the Real Estate Council of British Columbia sworn December 16, 2015 and Bellia Tan, Compliance Officer, of the Real Estate Council of British Columbia, sworn December 17, 2015:

The Discipline Committee determined that:

1. There has been conduct on the part of the brokerage, Lester Lin Realty and Jeffrey Fee, managing broker, in respect of which a Discipline Committee could make an order under section 43 of the Real Estate Services Act.

2. The length of time required to complete an investigation or hold a disciplinary hearing, or both, would be detrimental to the public interest.

FURTHER, the Discipline Committee considers it to be in the public interest to make an Order under section 45(2)(b) and (c) of the Real Estate Services Act requiring Lester Lin Realty and Jeffrey Fee, managing broker of Lester Lin Brokerage, to immediately cease permitting Yu-Hsiang (Lester) Lin from holding himself out as a licensee or unlicensed assistant associated with the brokerage and, further, to take steps to ensure that the brokerage is properly supervising the licensees associated with the brokerage as required under section 3-1(1)(c) of the Council Rules.

TAKE NOTICE that Lester Lin Realty and/or Jeffrey Fee, pursuant to section 45(6) of the Real Estate Services Act, may require a disciplinary hearing to be held by delivering written notice to the Real Estate Council.
