NOTICE OF PERMANENT SURRENDER OF LICENCE
Shannon Lee Craig, while licensed as a representative with Pace Realty Corporation, Prince George, requested the Real Estate Council of British Columbia to discontinue disciplinary proceedings against her as she had decided to permanently surrender her real estate licence. Ms. Craig was facing a disciplinary hearing into her professional conduct and would have been required to appear before a hearing committee of the Real Estate Council to respond to these allegations.
The allegations against Shannon Lee Craig in the Notice of Discipline Hearing are that she committed professional misconduct within the meaning of section 35(1)(a) of the Real Estate Services Act ("RESA") in that:
- contrary to section 27(1)(a) of RESA and section 3-4 of the Council Rules, she received numerous wire and/or internet payments directly into her personal bank account for rental property management services between 2013 and 2014 from tenants paying rents and security deposits, as well as monies from owners of various properties in Prince George in order to carry out repairs, all of which she paid to Pace Realty Corporation; and
- contrary to sections 3-2(2)(a) and 3-2(5) of the Council Rules, she failed to keep her managing broker informed that she was receiving wire and/or internet payments directly into her personal bank account from various tenants paying rents and deposits, as well as monies from owners of properties in order to carry out repairs.
There has been no discipline hearing or finding of fact with respect to these allegations, and no admissions to these allegations by Ms. Craig.
The Council was satisfied that, in the circumstances of this case, permanent surrender of Ms. Craig's licence in lieu of proceeding with disciplinary action was appropriate. The permanent surrender of Ms. Craig's licence is effective as of November 24, 2015, although her licence was surrendered to the Real Estate Council on December 23, 2014.
