Summary

REAL ESTATE COUNCIL OF BRITISH COLUMBIA DISCIPLINE DECISION

In the matter of the Real Estate Services Act

S.B.C. 2004 ch. 42

AND in the matter of a Consent Order pursuant to Section 41 of the Real Estate Services Act

Issue: Justin Thomas Love, representative, OK West Realty Corp., Vernon, entered into a Consent Order with the Council that he committed professional misconduct within the meaning of section 35(1)(a) of the Real Estate Services Act in that:

  1. in contravention of section 3-4 of the Council Rules, he failed to act with reasonable care and skill, in that he drafted the offer but left blank pertinent facts such as the date of the offer, the purchase price and the offer expiry date, while at the same time he caused the buyer to initial beside these blanks and to sign the offer, in order to use the offer at a future date should the property be offered for sale; and
  2. in contravention of section 3-4 of the Council Rules, he failed to act with reasonable care and skill, in that he provided for limited dual agency in the offer and had the buyer sign an undated Limited Dual Agency Agreement respecting the property, when at the time the buyer signed the offer and the Limited Dual Agency Agreement he did not know if limited dual agency would be proposed or agreed to by the seller or the buyer.

Results

Justin Thomas Love was subject to an Order of a discipline committee that he:

  1. be suspended for seven (7) days from June 10, 2015 to June 16, 2015 (inclusive);
  2. at his own expense, register for and successfully complete the Real Estate Trading Services Remedial Education Course; and
  3. pay enforcement expenses to the Council in the amount of $1,250.00.
