Summary

REAL ESTATE COUNCIL OF BRITISH COLUMBIA DISCIPLINE DECISION

In the matter of the Real Estate Services Act

S.B.C. 2004 ch. 42

AND in the matter of a Consent Order pursuant to Section 41 of the Real Estate Services Act

Issue: Amritpal (Am) Singh Randhawa, currently unlicensed, entered into a Consent Order with the Council that, while licensed with Tapestry Realty Ltd. dba Royal Group Tapestry Realty, Surrey, he committed professional misconduct within the meaning of section 35(1)(a) of the Real Estate Services Act in relation to the sale of property on 66A Avenue, Surrey and the potential purchase of property on 176A Street, Surrey, when he:

  1. failed to promptly remove the lockbox and brokerage sign from the property when the listing was cancelled on June 1, 2012, contrary to section 3-4 of the Council Rules;
  2. prepared a May 21, 2012 Addendum titled "Next Purchase" which purported to be a modified buyer Agency Agreement that did not include an end date, contrary to section 3-4 of the Council Rules;
  3. failed to ensure that both registered owners on title of the property signed the listing agreement, contrary to section 3-4 of the Council Rules; and
  4. failed to ensure that the Addendum dated May 22, 2012, which stated "subject to seller finding dream home to the satisfaction of the seller within 3 weeks of subject removal", was agreed to and signed by the buyer, contrary to section 3-3(b) of the Council Rules.

Results

Amritpal (Am) Singh Randhawa was subject to an Order of a discipline committee that he:

  1. be suspended for seven (7) days upon licence reissuance.;
  2. as a condition of relicensing, at his own expense, register for and successfully complete the Real Estate Trading Services Remedial Education Course within the time period as directed by the Council; and
  3. pay enforcement expenses to the Council in the amount of $1,250.00 within sixty (60) days of relicensing.
