ORDER TO FREEZE PROPERTY UNDER SECTION 46
Upon reading the Affidavit of Jane Kolonsky, Compliance Officer, of the Real Estate Council of British Columbia sworn this 3rd day of May, 2010,
I AM OF THE OPINION that:
- There has been conduct on the part of Bobby Baldeep Nagra in respect of which a Disciplinary Committee could make an Order under section 43 of the Real Estate Services Act.
- The length of time required to complete an investigation or hold a disciplinary hearing, or both, would be detrimental to the public
I CONSIDER IT in the public interest to make an Order under section 45(2) of the Real Estate Services Act suspending the license of Bobby Baldeep Nagra effective immediately and Order that he not provide any real estate
Further, I consider it in the public interest to make an Order under section 46 of the Real Estate Services Act, requiring the brokerage, Century 21 Coastal Realty Ltd., to hold all funds in the possession of the brokerage on behalf of Bobby Baldeep Nagra, including commissions or any funds otherwise payable to Bobby Baldeep Nagra until further order of the Real Estate Council.
Further, I consider it in the public interest to make an Order under section 46 of the Real Estate Services Act to direct TD Bank at 13650 72nd Avenue, Surrey, B.C., to hold any or all client funds and general accounts of Bobby Baldeep Nagra or Coach Holdings Ltd. until further order of the Real Estate Council.
Further, I consider it in the public interest to make an Order under section 46 of the Real Estate Services Act to direct TD Canada Trust at 15110 Bluff Road, North, White Rock, B.C. to hold any or all client funds and general accounts of Bobby Baldeep Nagra or Coach Holdings Ltd. until further order of the Real Estate Council.
Further, I consider it in the public interest to make an Order under section 46 of the Real Estate Services Act to direct Coast Capital Savings Credit Union to hold any or all client funds and general accounts of Bobby Baldeep Nagra
TAKE NOTICE that Bobby Baldeep Nagra may, pursuant to section 45(6) of the Real Estate Services Act, require a discipline hearing to be held by delivering writen notice to the Real Estate Council.
