Summary
Seyed-Amir-Mohammad Miri, while licensed with Royal LePage Sussex, failed to ensure that a disclosure of his interest in trade was witnessed properly.
Mr Miri was acting as a limited dual agent in a transaction, representing both his company (the seller) and the buyer. Mr. Miri had the buyer sign as a witness and as the buyer on the Disclosure of Interest in Trade form, despite clear instruction that the witness could not be a party to the trade.
Licensees have a duty to act honestly and with reasonable care and skill. Mr. Miri failed in his duties, contravening section 3-4 of the Rules.
Results
A discipline committee of the Council has ordered the following:
- Mr. Miri is reprimanded, and must pay a discipline penalty of $2,500.00 to the Council.
- Mr. Miri must pay enforcement expenses of $1,500.00 to the Council.
- At his own expense, Mr. Miri must successfully complete the Real Estate Trading Services Remedial Education Course.
As Mr. Miri has a personal real estate corporation, the licence of Amir Miri Personal Real Estate Corporation is also reprimanded, and is equally responsible for payment of the discipline penalty and enforcement expenses.
