Summary
Mark Joseph Epstein, while licensed with Prudential United Realty, acted as a strata's property manager. Mr. Epstein approved payment of an invoice out of funds the brokerage held in trust for the strata, without the strata's consent.
After the strata terminated their service agreement with the brokerage, Mr. Epstein failed to ensure that Prudential provided the successor brokerage with required records.
Licensees are required to act with reasonable care and skill. Mr. Epstein's failed in these requirements, contravening section 3-4 of the Rules.
Results
A discipline committee of the Council has ordered the following:
- Mr. Epstein is reprimanded.
- At his own expense, Mr. Epstein must successfully complete the Strata Management Remedial Education Course.
- Mr. Epstein must pay enforcement expenses of $1,250.00 to the Council.
