Summary
Kenneth David Drebit, while licensed as a managing broker with Pacific Quorum Properties Inc., did not adequately supervise a licensee at his brokerage, who directed the release of holdback funds to a seller in error.
Mr. Drebit did not ensure that the brokerage employee who authorized the funds' release obtained appropriate direction before doing so.
Mr. Drebit failed to be in active control of the brokerage's business, and to adequately supervise the representatives and employees of the brokerage. This contravened section 6(2) of the Real Estate Services Act, and 3-1(1) of the Rules.
Results
A discipline committee of the Council has ordered the following:
- Mr. Drebit is reprimanded, and must pay a discipline penalty of $1,000.00 to the Council.
- Mr. Drebit must pay enforcement expenses of $1,500.00 to the Council.
