Summary
Kirandip Singh Dhaliwal prepared a contract assignment between two parties and then provided the executed assignment and bank drafts for the assignment amount to a third party. This was an act of wrongful taking or deceptive dealing under section 35(1)(c) of the Real Estate Services Act, and contravened section 7(3) of the Act and section 3-4 of the Rules.
By failing to promptly deliver the bank drafts for the assignment to his brokerage, Mr. Dhaliwal contravened section 27(1)(a) and/or 27(1)(b) of the Real Estate Services Act, committed wrongful taking or deceptive dealing under section 35(1)(c) of the Act, and committed conduct unbecoming under section 35(2) of the Act.
Mr. Dhaliwal did not promptly provide his managing broker with the records in relation to his real estate services as required by sections 3-2(1)(b) and 3-4 of the Rules. His failure to provide the records constituted incompetence under section 35(1)(d) of the Real Estate Services Act, and conduct unbecoming under section 35(2) of the Act.
Mr. Dhaliwal did not keep his managing broker informed of the real estate services he provided and other activities he performed, which as a licensee he is required to do. This contravened sections 3-2(2)(a) and 3-4 of the Rules, and constituted incompetence under section 35(1)(d) of the Real Estate Services Act and conduct unbecoming under section 35(2) of the Act.
Results
A discipline committee of the Council has ordered the following:
- Mr. Dhaliwal is suspended for 60 days, from February 22, 2017 until April 22, 2017. He may not act as an unlicensed assistant during the suspension.
- Mr. Dhaliwal must be under the direct supervision of a managing broker for one year following the end of the suspension period.
- At his own expense, Mr. Dhaliwal must successfully complete the Real Estate Trading Services Remedial Education Course.
- Mr. Dhaliwal must pay enforcement expenses of $1,500.00 to the Council.
