Summary
Lambert Ma, while licensed as the managing broker of Multiple Realty Ltd., allowed an unlicensed person to provide real estate services on behalf of the brokerage.
Managing brokers have a duty to be actively engaged in the management of the brokerage, and to ensure that the business of the brokerage is carried out competently and in accordance with the Real Estate Services Act and Rules. Mr. Ma failed in this duty, contravening section 6(2) of the Act, and sections 3-1(1) and 3-1(2) of the Rules.
Results
A discipline committee of the Council has ordered the following:
- Mr. Ma is reprimanded.
- Mr. Ma must pay enforcement expenses of $1,500.00 to the Council.
