Summary
Ryan Gurinder Rana deceived the Council as to his compliance with the Council's educational requirements, by arranging for someone else to write the licensing examination on his behalf. He then indicated on his application for licensing that he had passed the examination. These actions were found to constitute conduct unbecoming a licensee under section 35(2) of the Real Estate Services Act.
Mr. Rana made a false or misleading statement on his application by indicating that he had passed the licensing examination. This was professional misconduct under section 35 (1)(g) of the Real Estate Services Act.
Mr. Rana, while licensed with Sutton Group West Coast Realty Ltd. (Langley Branch Office), engaged in deceptive dealing when he intentionally misrepresented his qualifications to hold a real estate licence, or intentionally failed to disclose that he was not qualified to hold a real estate license, to his own clients and other parties. This was professional misconduct under section 35(1)(c) of the Real Estate Services Act.
Mr. Rana provided real estate services while unlicensed. His actions contravened section 3(1) of the Real Estate Services Act.
Results
A discipline committee of the Council has ordered the following:
- Mr. Rana's licence is cancelled, with no right to apply for licensing for a period of eight years.
- Mr. Rana must pay a discipline penalty of $7,500.00 to the Council.
- Mr. Rana must pay enforcement expenses of $1,500.00 to the Council.
As Mr. Rana has a personal real estate corporation, the licence of Ryan Rana Personal Real Estate Corporation is also cancelled, and it is equally responsible for the payment of the discipline penalty and enforcement expenses.
