Summary
Ehsan Sharenejad was representing the sellers of a property. In the listing agreement, the payment for remuneration was based on the difference between the price at which the property was listed for sale and the actual price for which it was sold. This is prohibited under the section 5-14 of the Rules.
Mr. Sharenejad prepared an Assignment Contract for his client, as assignor, which incorrectly identified the amount of deposits paid as less than the amount that his client actually paid. This resulted in a shortfall in the amount the client received as a result of the assignment. Mr. Sharenejad's actions contravened section 3-4 of the Rules, which require a licensee to act with reasonable care and skill.
Mr. Sharenejad incorrectly indicated on the Assignment Contract that he was acting as a Limited Dual Agent, and had his client execute a Limited Dual Agency Agreement. In fact, Mr. Sharenejad was not acting as a Limited Dual Agent, but as a Designated Agent. Mr. Sharenejad's actions contravened section 3-4 of the Rules.
Results
A discipline committee of the Council has ordered the following:
- Mr. Sharenejad is reprimanded, and must pay a discipline penalty of $5,000.00 to the Council.
- At his own expense, Mr. Sharenejad must successfully complete the Real Estate Trading Services Remedial Education Course.
- Mr. Sharenejad must pay enforcement expenses of $1,250.00 to the Council.
