Summary
Antony Guy Akester did not complete the mandatory Relicensing Education Program (REP) course prior to the expiration of his licence and prior to submitting his application for licence renewal. His actions contravened section 2-8.1 of the Council Rules.
Mr. Akester indicated in his licence renewal application that he had completed the REP course prior to the expiration of his licence. In fact, Mr. Akester had not completed the course before submitting his licence renewal application. Mr. Akester's statement was false or misleading, contravening section 35(1)(g) of the Real Estate Services Act.
Wayne Albert Smithies certified on Mr. Akester's licence renewal application that Mr. Akester had completed the REP course when he had not. By doing so, Mr. Smithies allowed Mr. Akester to make a false or misleading statement. Mr. Smithies' actions contravened section 6(2) of the Real Estate Services Act.
When he failed to ensure that Mr. Akester had completed the mandatory REP course in the time frame required under section 2-8.1 of the Council Rules, Mr. Smithies contravened section 3-1(1) of the Council Rules.
Results
A discipline committee of the Council has ordered the following:
- Mr. Akester and Mr. Smithies are each reprimanded, and must each pay a discipline penalty of $1,000.00 to the Council.
- Mr. Akester and Mr. Smithies are jointly and severally liable to pay enforcement expenses of $1,500.00 to the Council.
