CANCELLATION ORDER UNDER SECTION 43(4) OF THE REAL ESTATE SERVICES ACT
Upon reading the Affidavits of Carmen deFoy, Angie Smith and Janet Murray, Compliance Officers with the Real Estate Council of British Columbia, sworn July 28, 2016 and upon hearing the submissions of counsel for the Real Estate Council of British Columbia ("Council"), this Discipline Committee is satisfied that the requirements in section 43(4) of the Real Estate Services Act have been met and ORDERS THAT:
- The licence of Denise Renee Decary be canceled effective immediately pursuant to sections 43(4) of the Real Estate Services Act.
- The Council will not consider an application for re-licensing from Ms. Decary:
- for a period of one (1) year from the date of this Order;
- until the enforcement expenses and any other monies owing to the Council have been paid; and
- unless she has successfully completed the remedial Rental Property Management Remedial Education Course as provided by the Real Estate Division, Sauder School of Business at the University of British Columbia within the six month period preceding her application for re-licensing.
