Summary
Holland Park Property Marketing Ltd. failed to file an Accountant's Report with the Council for its fiscal year within the time frame required. This contravened section 7-7(1) of the Council Rules.
Samuel Everard Whiffin failed to fulfill his responsibilities as a managing broker for the performance of duties imposed on the brokerage by its licence. This contravened section 6(2)(b) of the Real Estate Services Act.
Mr. Whiffin failed to ensure that the Accountant's Report was filed for its fiscal year within the time frame required by the Council. This contravened sections 3-1(1)(a) and (b) and 3-1(3) of the Council Rules.
Mr. Whiffin failed to promptly respond to the Council's correspondence regarding issues identified during the brokerage audit and in the Accountant's Report filing. This contravened section 2-19 of the Council Rules.
Results
A discipline committee of the Council has ordered the following:
- Mr. Whiffin and Holland Park Property Marketing Ltd. are each reprimanded.
- Mr. Whiffin and Holland Park Property Marketing Ltd. are jointly and severally liable to pay a discipline penalty of $2,500.00 to the Council.
- Mr. Whiffin and Holland Park Marketing Ltd. are jointly and severally liable to pay enforcement expenses of $1,250.00 to the Council.
