Summary
Robert Quinn Lee was acting for a client in the sale of a property. Mr. Lee failed to act honestly and with reasonable care and skill when he led a buyer's licensee to believe that he had presented the buyer's offer to the seller and the offer had been rejected. In fact he had never presented the offer to the seller. Mr. Lee's actions contravened section 3-4 of the Council Rules.
Mr. Lee failed to disclose to his client (prior to accepting an offer) that another licensee had indicated that his client wished to present an offer. His actions contravened sections 3-3(a) and 3-3(f) of the Council Rules.
Results
A discipline committee of the Council has ordered the following:
- Mr. Lee is suspended for fourteen (14) days, from July 6, 2016 to July 19, 2016 inclusive.
- Mr. Lee must pay enforcement expenses of $1,500.00 to the Council.
As Mr. Lee has a personal real estate corporation, the licence of Robert Q. Lee Personal Real Estate Corporation is also suspended, and it is equally responsible for the payment of the enforcement expenses.
