Summary
Lin (Kelly) Kong acted in a deceptive manner while representing the seller of a property. Ms. Kong caused another licensee to insert his name on the Contract of Purchase and Sale as providing agency to the buyer, when he was not providing any services to the buyer.
Ms. Kong also permitted another licensee to sign the Working with a Realtor Brochure and to record the buyer's personal information on the Canadian Real Estate Association's Individual Identification Information Record Form.
Ms. Kong knew or ought to have known that the licensee had never met or spoken to the buyer. Her actions were in violation of section 35(1) of the Real Estate Services Act.
Results
A discipline committee of the Council has ordered the following:
- Lin (Kelly) Kong is suspended for ninety (90) days, from June 22, 2016 to September 19, 2016 inclusive.
- At her own expense, she must successfully complete the Real Estate Trading Services Remedial Education course.
- She must pay enforcement expenses of $1,500.00 to the Council.
