Summary

Marc Edward Thomas Burrows and Howard Paul Isaacs acted as the listing agents in the sale of a new home built by an owner builder under the provisions of the Homeowner Protection Act. They failed to ensure that an owner-builder disclosure notice required by section 21(2) of that Act was provided to the buyer prior to the sale.

Mr. Burrows and Mr. Isaacs subsequently acted as the listing agents in the sale of another new home built by an owner builder under the provisions of the Homeowner Protection Act. The owner had not lived in the home for the prescribed period of 12 months after the home was built before offering it for sale, in contravention of section 20.1 of the Homeowner Protection Act. Mr. Burrows and Mr. Isaacs listed and marketed the property when they knew that the Homeowner Protection Office had issued a Compliance Order requiring that the owner cease offering the property for sale. Their actions contravened sections 3-4 and 5-13(1)(c) of the Council Rules.

Mr. Isaacs advised the Homeowner Protection Office that the property would be "delisted" and then deliberately failed to do so. This action constituted conduct unbecoming a licensee and contravened section 3-4 of the Council Rules.

Mr. Burrows advised the Homeowner Protection Office that the listing of the property had been cancelled when he knew that was untrue. This action constituted conduct unbecoming a licensee and contravened section 3-4 of the Council Rules.

Mr. Burrows and Mr. Isaacs deliberately failed to submit a cancellation of the listing executed by their managing broker. This action constituted conduct unbecoming a licensee.

Results

A discipline committee of the Council has ordered the following:

  1. Mr. Burrows' licence is suspended for fourteen (14) days from June 8, 2016 to June 22, 2016 inclusive. The suspension must take place concurrently with the suspension of Mr. Isaacs.
  2. Mr. Burrows, at his own expense, must successfully complete the Real Estate Trading Services Remedial Education Course.
  3. Mr. Burrows must pay enforcement expenses of $1,500.00 to the Council.
  4. Mr. Isaacs' licence is suspended for fourteen (14) days from June 8, 2016 to June 22, 2016 inclusive. The suspension must take place concurrently with the suspension of Mr. Burrows.
  5. Mr. Isaacs, at his own expense, must successfully complete the Real Estate Trading Services Remedial Education Course.
  6. Mr. Isaacs must pay enforcement expenses of $1,500.00 to the Council.
