Summary

Proline Management Ltd. failed to provide a property owner with a Condition Inspection Report when requested following the departure of tenants from her property. The brokerage also failed to provide the property owner with a list of suggested repairs and costs, and failed to respond to the owner's inquiries in a timely fashion.

The brokerage's actions contravened section 3-3(a) of the Council Rules.

Andrew Spurling, a managing broker for Proline Management Ltd., failed to ensure that the brokerage's business was carried out competently when he did not inform the owner about the condition of her property after the tenants moved out. Mr. Spurling also did not ensure that rental property management representatives responded to the owner's emails and provided the owner with a Condition Inspection Report and a Iist of repairs and costs when requested.

Mr. Spurling's actions contravened section 6(2)(c) of the Real Estate Services Act and/or sections 3-1(1)(b) and 3-1(1)(c) of the Council Rules.

Michael Mendel Peters, as rental property manager for the property, did not keep the owner informed about the condition of her property after the tenants moved out, despite numerous email requests from the owner. Mr. Peters also failed to provide the owner with a Condition Inspection Report and a Iist of repairs and costs when requested.

Mr. Peters' actions contravened sections 3-3(a), 3-3(b), 3-3(c) and 3-4 of the Council Rules.

Arnold Hobson, as the acting rental property manager for the property, did not ensure that a licensee in his department kept the owner informed about the condition of her property after the tenants moved out. Mr. Hobson failed to provide her with the Condition Inspection Report when requested.

Mr. Hobson's actions contravened section 3-3(a) and 3-4 of the Council Rules.

Results

A discipline committee of the Council ordered the following:

  1. Michael Mendel Peters, Arnold Hobson, Andrew Christopher Spurling and Proline Management Ltd. are reprimanded.
  2. Proline Management Ltd. must pay a discipline penalty of $2,500.00 to the Council.
  3. At his own expense, Mr. Peters must successfully complete the Rental Property Management Remedial Education Course.
  4. Mr. Peters, Mr. Hobson, Mr. Spurling, and Proline Management Ltd. must pay enforcement expenses of $1,500.00 to the Council.
