Kamaljit (Kam) Singh Minhas permitted his clients to initial an Addendum to a Contract of Purchase and Sale indicating they had received the Disclosure Statement for a property, when they had not. Mr. Minhas then failed to ensure that his clients received and reviewed the Disclosure Statement for the property prior to the expiry of their rescission period. These actions were in contravention of section 3-3(a) of the Council Rules, which requires licensees to act in the best interests of the client.

Mr. Minhas did not ensure that his clients had material information about the property they were purchasing. The clients had viewed a 2-bedroom unit and believed they were purchasing such a unit, when they had in fact purchased a commercial live/work unit. Mr. Minhas’s failure to use reasonable care and skills to discover relevant facts about the property contravened sections 3-3(h) and 3-4 of the Council Rules.

A discipline committee of the Council has ordered the following:

  1. Kamaljit (Kam) Singh Minhas is suspended for twenty-one (21) days from January 13, 2016 to February 2, 2016 (inclusive).
  2. He must successfully complete the Real Estate Trading Services Remedial Education Course.
  3. He must pay $1,500.00 in enforcement expenses to the Council.
