Summary of File 13-300

Derek Douglas Gillette published statements on the website for a company of which he was the president and director, apparently offering to provide real estate services outside of his brokerage. This contravened section 7(3)(a) of the Real Estate Services Act.

The real estate advertising published by Mr. Gillette did not contain his licensee name and the name of the brokerage. This contravened sections 4-6(2) and 4-6(3) of the Council Rules.

Summary of File 13-275

Mr. Gillette had sellers sign an incomplete listing agreement, as they wanted to get their property on the market as soon as they were no longer obligated with respect to a previous listing agreement with another brokerage. Mr. Gillette later filled in the missing information, and assumed that the sellers would ratify the information. Instead, the sellers tried to cancel the agreement. Mr. Gillette's actions contravened section 3-4 of the Council Rules.

Results

A discipline committee of the Council has ordered the following:

  1. Derek Gillette and Derek Gillette Personal Real Estate Corporation are reprimanded.
  2. Mr. Gillette must successfully complete the Real Estate Trading Services Remedial Education Course.
  3. He must pay a discipline penalty of $2,500.00 to the Council.
  4. He must pay enforcement expenses of $1,500.00 to the Council.
