Date of Consent Order: October 26, 2015

Issue: Yo-Cherng (Jeremy) Liou, representative, Sunstar Realty Ltd., Vancouver, entered into a Consent Order with the Council that he committed professional misconduct within the meaning of section 35(1)(a) of the Real Estate Services Act by contravening sections 3-3(a) and 3-4 of the Council Rules in that he:

(a) failed to act in the best interest of the buyers by leaving the buyers when the listing representative was going over the Contract of Purchase and Sale before the buyers signed the contract;

(b) failed to ascertain the actual purchase price the buyers would be paying prior to them signing the Contract of Purchase and Sale as the buyers thought they were paying $407,900.00 with no GST added; and

(c) failed to recommend to the buyers to obtain independent GST advice before they signed the Contract of Purchase and Sale.

Result: Yo-Cherng (Jeremy) Liou was subject to an Order of a discipline committee that he: (a) be suspended for seven (7) days from December 2, 2015 to December 8, 2015 inclusive; (b) at his own expense, register for and successfully complete the Real Estate Trading Services Remedial Education Course; and (c) pay enforcement expenses to the Council in the amount of $1,500.00.
