Date of Consent Order: November 5, 2015

Issue: Fatemeh (Fatima) Nouripour, representative, New Century Real Estate Ltd., Vancouver, entered into a Consent Order with the Council that she committed professional misconduct within the meaning of section 35(1)(a) and (d) of the Real Estate Services Act when she:

(a) contravened section 5-9 of the Council Rules in that she failed to provide the seller of the property with a completed Disclosure of Interest and Trade Form, when she, as a licensee, entered into a Contract of Purchase and Sale for that property, while being represented, as buyer, by her managing broker;

(b) failed to advise KH to seek independent legal advice or representation concerning the joint venture agreement that she intended to enter into with KH, prior to entering into that agreement; and

(c) contravened section 27(1) of the Real Estate Services Act in that she failed to promptly pay the Assignee’s deposit money into her brokerage’s trust account when she, as the Assignor, accepted their deposit cheque for the assignment of the Contract of Purchase and Sale and deposited that cheque into her personal bank account without a separate written agreement as required by section 27(4) of the Real Estate Services Act.

Result: Fatemeh (Fatima) Nouripour was subject to an Order of a discipline committee that she: (a) be suspended for thirty (30) days from December 9, 2015 to January 7, 2016 inclusive; (b) at her own expense, register for and successfully complete the Real Estate Trading Services Remedial Education Course; and (c) pay enforcement expenses to the Council in the amount of $1,250.00.
