Date of Consent Order: August 4, 2015
Issue: Trevor William Maxwell Inglis, representative, Crest Realty Ltd. dba RE/MAX Crest Realty, North Vancouver, entered into a Consent Order with the Council that he committed professional misconduct within the meaning of section 35(1)(a) of the Real Estate Services Act in that, in contravention of section 3-4 of the Council Rules, he failed to act honestly and with reasonable care and skill, in that on or about November 13, 2012 he negotiated with one or both of the listing agents a price reduction to the purchase price in the contract and a reduction in the deposit set out in the contract based on his assertion to one or both of the listing agents that the buyers had received no offers on the buyers' property, but the buyers would remove the subject clause and "take all the risk" even though they had not sold the buyers' property, when at the time he made those statements the buyers had in fact previously entered into the buyers' property contract for the sale of the buyers' property, which was subject to satisfaction of certain conditions, on or before November 16, 2012, and he failed to disclose those facts to any of the sellers or the listing agents.
Results
Trevor William Maxwell Inglis was subject to an Order of a discipline committee that he:
- be reprimanded;
- pay a discipline penalty to the Council in the amount of $6,000.00;
- at his own expense, register for and successfully complete the Real Estate Trading Services Remedial Education Course; and
- pay enforcement expenses to the Council in the amount of $1,250.00.
