REAL ESTATE COUNCIL OF BRITISH COLUMBIA DISCIPLINE DECISION
In the matter of the Real Estate Services Act
S.B.C. 2004 ch. 42
AND in the matter of a Consent Order pursuant to Section 41 of the Real Estate Services Act
Issue: Min (Judy) Zhu and Judy Zhu Personal Real Estate Corporation, while licensed as Min (Judy) Zhu, representative, Royal Pacific Realty Corp., Vancouver, entered into a Consent Order with the Council that she committed professional misconduct within the meaning of section 35(1)(a) of the Real Estate Services Act in that she:
- failed to ensure there was an adequate level of supervision for her unlicensed assistant, contrary to section 3-2(4) of the Council Rules, by permitting him to perform services for which a license is required;
- caused the publication of real estate advertising that she knew or reasonably ought to have known contained a false or misleading statement or misrepresentation, contrary to section 4-7 of the Council Rules; and
- in connection with trading services provided to Ms. H., she:
- failed to ensure there was an adequate level of supervision for her unlicensed assistant, contrary to section 3-2(4) of the Council Rules; and
- failed to disclose to her client, Ms. H., that her assistant was unlicensed, contrary to section 3-4 of the Council Rules.
Results
Min (Judy) Zhu was subject to an Order of a discipline committee that she:
- be suspended for fourteen (14) days from June 10, 2015 to June 23, 2015;
- at her own expense, register for and successfully complete the Real Estate Trading Services Remedial Education Course; and
- pay enforcement expenses to the Council in the amount of $1,500.00.
