Respondent: Sukhwant (Mintu) Khun Khun

Date of Consent Order:  June 6, 2014

Issue: Sukhwant (Mintu) Khun Khun, representative, Century 21 Coastal Realty Ltd., Surrey, entered into a Consent Order with the Council that he committed professional misconduct within the meaning of section 35(1)(c) of the Real Estate Services Act and sections 3-4 and 5-3(1) of the Council Rules in that he:

(a) altered the Exclusive Buyer’s Agency Contract (the “contract”) between the client and the brokerage by:

(i) inserting a new date on the contract;
(ii) affixing the client’s initials on the contract;
(iii) signing the name of the client on the contract; and
(iv) affixing his own signature as a witness to the purported client’s signature on the contract;

all without the client’s authorization or consent; and

(b) when the brokerage determined it would commence a small claims action against the client for breach of the contract, and in fact did commence a small claims action against the client, he did not advise the brokerage that he had in fact altered the contract, and as such knowingly permitted the small claims action to continue, and participated fully in pursuing the said small claims action.

Result: Sukhwant (Mintu) Khun Khun was subject to an Order of a discipline committee that he: (a) be suspended for one hundred and fifty (150) days, from July 9, 2014 to December 5, 2014 (inclusive); (b) at his own expense, register for and successfully complete the Real Estate Trading Services Remedial Education Course; and (c) pay enforcement expenses to the Council in the amount of $1,250.00.
