Issue:Marjan Mazaheri and Marjan Mazaheri Personal Real Estate Corporation, 0808799 BC Ltd. dba Coldwell Banker Prestige Realty, Vancouver, was found by a Discipline Hearing Committee to have committed professional misconduct within the meaning of section 35(1)(d) of the Real Estate Services Act while licensed as Marjan Mazaheri, representative, Crest Realty Ltd. dba Re/Max Crest Realty, Vancouver, in that she:

 (a) marketed and sold Alberta development units in British Columbia without a disclosure statement for those units filed with the Superintendent of Real Estate in British Columbia, contrary to section 14 of the Real Estate Development Marking Act and section 3-4 of the Council Rules; and

 (b) received deposits in British Columbia from British Columbia residents and forwarded those deposits to an Alberta lawyer, rather than ensuring that the deposits were held in a trust account in a savings institution in British Columbia, contrary to section 18 of the Real Estate Development Marketing Act and section 3-4 of the Council Rules.

Issue:Douglas Yin Soo and Douglas Soo Personal Real Estate Corporation, 0808799 BC Ltd. dba Coldwell Banker Prestige Realty, Vancouver, while licensed as Douglas Yin Soo, representative, Crest Realty Ltd. dba Re/Max Crest Realty, Vancouver, was found by a Discipline Hearing Committee to have committed professional misconduct within the meaning of section 35(1)(d) of the Real Estate Services Act in that he:

 (a) marketed and sold Alberta development units in British Columbia without a disclosure statement for those units filed with the Superintendent of Real Estate in British Columbia, contrary to section 14 of the Real Estate Development Marking Act and section 3-4 of the Council Rules; and

 (b) received deposits in British Columbia from British Columbia residents and forwarded those deposits to an Alberta lawyer, rather than ensuring that the deposits were held in a trust account in a savings institution in British Columbia, contrary to section 18 of the Real Estate Development Marketing Act and section 3-4 of the Council Rules.

Result:Marjan Mazaheri and Marjan Mazaheri Personal Real Estate Corporation was subject to an Order of a discipline committee that they be suspended for seven (7) days from April 9, 2014 to April 15, 2014, (inclusive).

Result:  Douglas Yin Soo and Douglas Soo Personal Real Estate Corporation was subject to an Order of a discipline committee that they be suspended for fourteen (14) days, from April 16, 2014 to April 29, 2014 (inclusive).

 Result: Marjan Mazaheri and Douglas Yin Soo were subject of an Order of a discipline committee that they be jointly and severally liable to pay enforcement expenses to the Council in the amount of $2,200.00.
