Date of Consent Order:  February 5, 2014

Issue: Raymond John Blender, managing broker, Camosun Properties Ltd. dba Re/Max Camosun, Victoria, Re/Max Camosun (Sid), Sidney, Re/Max Camosun (VicGld), Victoria, and Re/Max Camosun (VicOak), Victoria, entered into a Consent Order with the Council that, while licensed as managing broker with Re/Max Camosun, he committed professional misconduct within the meaning of section 35(1)(a) of the Real Estate Services Act in that he, contrary to section 35(1)(d), demonstrated incompetence in performing a duty for which a licence is required and contrary to section 3-1(c) of the Council Rules, failed to ensure that there was an adequate level of supervision for a representative who performed duties on behalf of the brokerage or both by failing, when the licensee consulted him, to advise the licensee to inspect in person the building permits for the property for which the licensee was the seller’s representative after the seller had told the licensee that water had entered the basement of the property and that repairs had been effected to the perimeter drainage which had corrected the problem.

Result: Raymond John Blender was subject to an Order of a discipline committee that he: (a) both his primary and secondary licences be suspended for seven days, from March 12, 2014 to March 18, 2014 (inclusive); and (b) pay enforcement expenses to the Council in the amount of $1,000.00.
