Date of Consent Order:  January 7, 2014

Issue: Edith Yim Ping Wong, associate broker, West Coast Realty Ltd. (Van49) dba Sutton Group – West Coast Realty (Van49), Vancouver, entered into a Consent Order with the Council that she committed professional misconduct within the meaning of section 35(1)(a) of the Real Estate Services Act when she:

(a) contravened section 7(3)(a) of the Real Estate Services Act by providing real estate services separate from the brokerage in relation to which she was licensed when she provided rental property management services for a property from approximately September 2010 to July 2012 in that she:

(i) provided a rental application and rental agreement to the tenant on behalf of the landlord for the tenant to complete and sign;

(ii) arranged and conducted showings of the property on behalf of the owner;

(iii) handled and returned rental cheques and the security deposit on behalf of the owner;

(iv) managed landlord and tenants matters on behalf of the landlord through regular e-mail correspondence with the tenant; and

(v) managed landlord and tenant matters when she, inter alia, conducted a move out inspection, collected property keys and advised the tenant that she would reimburse her for the cost of key cutting, all on behalf of the owner.

(b) contravened section 7(3)(a) of the Real Estate Services Act, by providing real estate services separate from the brokerage in relation to which she was licensed when she provided rental property management services for various owners of properties when she, inter alia, arranged and conducted showings of the properties on behalf of the owners;

(c) contravened section 3-2(2)(a) of the Council Rules when she failed to keep her managing broker informed of the real estate services being provided, and other activities being performed by her on behalf of the brokerage; and

(d) contravened sections 4-5, 4-6(1) and 4-6(2) of the Council Rules when she published advertisements that failed to be in compliance with the Rules; in that she published advertisements on Craigslist that offered for rental properties, which advertisements failed to: 

(i) clearly indicate Ms. Wong’s licensee name, if at all; and

(ii) provide the licensee name of Ms. Wong’s brokerage in a prominent and easily readable way, if at all.

Result: Edith Yim Ping Wong was subject to an Order of a discipline committee that she: (a) be suspended for ten (10) days, from February 12, 2014 to February 21, 2014 (inclusive); and (b) pay enforcement expenses to the Council in the amount of $1,250.00.
