Date of Consent Order:    January 22, 2013 

Issue: Amarit Dass, representative, Homelife Glenayre Realty Company Ltd., Abbotsford, entered into a Consent Order with the Council that he committed professional misconduct within the meaning of section 35(1)(a) of the Real Estate Services Act in connection with the sale of property from L.D. as seller, and V.K., J.G. and S.R. as buyers by Contract of Purchase and Sale dated November 22, 2006 (the :Contract”) in that he:

(a) removed himself as a buyer from the contract without advising the buyers of this until after the subjects were removed and the contract was a firm contract, contrary to section 3-3(1)(a) of the Council Rules;

(b) failed to obtain the signatures of V.K. and S.R. on the Fee Agreement dated November 22, 2006, contrary to section 3-4 of the Council Rules;

(c) failed to obtain the signatures of the buyers on the Addendum to the Contract of Purchase and Sale dated February 2, 2007, contrary to section 3-4 of the Council Rules;

(d) failed to avoid a conflict of interest by failing to refer the buyers to another representative when he was also a buyer to the contract and representative for the buyers, contrary to section 3-3(1)(i) of the Council Rules; and

(e) failed to promptly and fully disclose to the client the conflict of interest he was in when he was a principal to the transaction and the representative for the buyers, contrary to section 3-3(1)(j) of the Council Rules. 

Result: Amarit Dass was suspended for one hundred and fifty (150) days, from March 20, 2013 to August 16, 2013 (inclusive), and ordered to pay a discipline penalty to the Council in the amount of $7,500.00, to successfully complete the Real Estate Trading Services Remedial Education Course, and to pay enforcement expenses to the Council in the amount of $3,000.00.
