Issue: Edward (Ed) Wallace Walker, representative, City Realty Ltd. dba Re/Max City Realty, Vancouver, while licensed with Local Venture Corp. dba Homeland Realty, Vancouver, was found by a Discipline Hearing Committee to have committed professional misconduct within the meaning of section 35(1)(a) of the Real Estate Services Act, in that he:

(a) failed to apply reasonable care and skill and failed to act in the best interests of his clients in that he did not adequately explain to his clients the commission that would be earned in the event of a sale of their property, contrary to sections 3-4 and 3-3(1)(a) of the Council Rules; and

(b) published an advertisement in the Real Estate Weekly newspaper that he knew to be false and/or misleading in that the advertisement stated that a client could “sell your home on MLS® for $399” when that was not true or was only true in very limited circumstances which are not set out clearly in the advertisement and/or were not adequately explained to his client, contrary to section 4-7 of the Council Rules. 

Result: Edward (Ed) Wallace Walker was suspended for seven (7) days from March 6, 2013 to March 12, 2013 (inclusive) and was ordered to pay enforcement expenses to the Council in the amount of $1,500.00.
