ORDERS UNDER SECTION 45
Upon reading the Affidavit of Angie Smith, Senior Compliance Officer of the Real Estate Council of British Columbia, sworn May 8, 2012.
I AM OF THE OPINION that:
- There has been conduct on the part of Smrat (Sam) Sharma in respect of which a Disciplinary Committee could make an order under section 43 of the Real Estate Services Act.
- There has been conduct on the part of John Shiong-Ma and Multiple Realty Ltd. in respect of which a Discipline Hearing Committee could make an order under section 43 of the Real Estate Services Act.
- The length of time required to complete an investigation or hold a disciplinary hearing, or both, would be detrimental to the public interest.
I CONSIDER IT in the public interest to make an Order under section 45(2) of the Real Estate Services Act suspending the licence of Smrat (Sam) Sharma effective immediately and Order that he not provide any real estate services to or on behalf of any member of the public.
I CONSIDER IT in the public interest to make an Order under section 45(2) of the Real Estate Services Act requiring the brokerage pursuant to section 45(2)(c) by this Order to pay the sum of $510,000 into the brokerage trust account at the Bank of Nova Scotia, Kingsway at Victoria Branch, Vancouver, B.C. to cover the trust shortage in that amount.
TAKE NOTICE that Smrat (Sam) Sharma, John Shiong-Ma, and /or Multiple Realty Ltd. may, pursuant to section 45(6) of the Real Estate Services Act, require a disciplinary hearing to be held by delivering written notice to the Real Estate Council.
