Issue: Richard Kurt Otto Wittstock, currently unlicensed, entered into a Consent Order with the Council that, while licensed as a managing broker with Amacon Realty Ltd., Vancouver, he committed professional misconduct within the meaning of section 35(1)(a) of the Real Estate Services Act in that he, in submitting his application for licence renewal:
(a) contravened section 35(1)(g) of the Real Estate Services Act by confirming that he had completed the course requirements of the Council ’s Relicensing Education Program prior to the expiration of his licence and certified that the information contained in his application for licence renewal was true and complete, when he had not completed the course requirements; and
(b) contravened section 2-8.1 of the Council Rules by failing to complete the course requirements of the Council ’s Relicensing Education Program prior to the expiration of his licence and prior to submitting his application to the Council for renewal of his licence, and was thus not qualified to be licensed, pursuant to section 10(b)(ii) of the Real Estate Services Act.
Result: Richard Kurt Otto Wittstock was reprimanded, was ordered to pay a discipline penalty to the Council in the amount of $1,000.00, and was ordered to pay enforcement expenses to the Council in the amount of $1,000.00.
