Issue: James George Krahn, currently unlicensed, entered into a Consent Order with the Council in which he consented to an Order that, while licensed as a representative, West Coast Realty Ltd. (Vic) dba Sutton Group –West Coast Realty (Vic), Victoria, he committed professional misconduct within the meaning of section 35(1)(a) of the Real Estate Services Act in that he: (a) failed to provide his managing broker with a copy of a contract, contrary to section 3-2(1) of the Council Rules; (b) failed to immediately notify his managing broker when the deposit called for in the contract was not received, contrary to section 3-2(2)(b) of the Council Rules; and (c) failed to complete the requirements for written disclosure of his interest in the trade which was the subject of the contract, in accordance with section 5-9 of the Council Rules.
Result: James George Krahn was suspended for twenty-one (21) days, but as he has voluntarily remained unlicensed since April 15, 2010, twenty-one (21) days of the period between April 15, 2010 and July 15, 2010 would be counted towards his suspension. As such, Mr. Krahn was suspended from June 25, 2010 to July 15, 2010 (inclusive). In addition, Mr. Krahn was ordered to successfully complete the Trading Services Remedial Education Course and pay enforcement expenses to the Council in the amount of $1,000.00.
