IN THE MATTER OF THE REAL ESTATE SERVICES ACT

S.B.C. 2004, c. 42

AND

IN THE MATTER OF

STEPHEN THOMAS JOHNSON

ORDER UNDER SECTION 43(4) OF THE REAL ESTATE SERVICES ACT

Whereas on August 12, 2009 a Real Estate Council of British Columbia Discipline Committee, in the form of a Consent Order Review Committee, ordered that:

  1. Stephen Thomas Johnson ( "Mr. Johnson "), as conditions of continued licensing, complete the "Real Estate E&O Insurance Legal Update 2009 " and pay Council 's enforcement expenses of $1000.00 by December 9, 2009;
  2. If Mr. Johnson fails to comply with the terms of this order the Council could suspend or cancel Mr. Johnson 's licence without further notice to him pursuant to section 43(3) and 43(4) of the Real Estate Services Act.
  3. Whereas on December 23, 2009 at Mr. Johnson 's request the Council ordered that:
  4. The Council would substitute the Trading Services Remedial Licensing Course offered at the Sauder School of Business for the "Legal Update " course he was ordered to attend as it was not being offered in his area in the near future;
  5. Mr. Johnson would be granted an extension of time until February 28, 2010 to complete the Trading Services Remedial Licensing Course offered at the Sauder School of Business and to pay Council 's enforcement expenses of $1000.00;
  6. If Mr. Johnson failed to comply with the terms of this extension the Council could suspend or cancel his licence without further notice to him pursuant to section 43(3) and 43(4) of the Real Estate Services Act.
  7. Whereas on March 31, 2010 at Mr. Johnson 's request the Council ordered that:
  8. Mr. Johnson would be granted a further extension of time until April 28, 2010 to complete the Trading Services Remedial Licensing Course offered at the Sauder School of Business and to pay Council 's enforcement expenses of $1000.00;
  9. Mr. Johnson was again advised that if he did not to comply with these conditions the Council could suspend or cancel his licence without further notice to him pursuant to section 43(3) and 43(4) of the Real Estate Services Act.

Whereas on May 13, 2010 the Council denied Mr. Johnson 's further extension request and advised that:

As he failed to complete the Trading Services Remedial Licensing Course by the extended deadline of April 28, 2010 and to pay the enforcement expense of $1000.00 by the extended deadline of April 28, 2010 he was requested to surrender his licence to the Council no later than Monday, May 17, 2010; Should it not be received by that time, the Council would suspend his licence without further notice to him.

Whereas as of May 18, 2010 Mr. Johnson has not completed the Trading Services Remedial Licensing Course, has not paid the enforcement expense of $1000.00 by the extended deadline of April 28, 2010 and has not surrendered his licence to the Council 's Licensing Supervisor:

This Discipline Hearing Committee orders that Mr. Johnson 's licence is hereby suspended until such time as he completes the Trading Services Remedial Licensing Course and he pays the enforcement expenses of $1000.00.
