Issue: Alexander Hart, currently unlicensed, entered into a Consent Order with the Council in which he consented to an Order that, while licensed as a representative with Sunrich Realty Ltd. dba Amex Sunrich Realty, Richmond, he: (a) committed professional misconduct within the meaning of section 35(1)(a) of the Real Estate Services Act by: (i) contravening section 27(1) of the Real Estate Services Act; and (ii) listed and marketed a property without the consent of the owner of the property, contrary to section 4-8 of the Council Rules; (b) committed professional misconduct within the meaning of section 35(1)(d) of the Real Estate Services Act by: (i) entering into a tenancy agreement on behalf of a client that contained a term contrary to the provisions of the Residential Tenancy Act; and (ii) breaching said tenancy agreement; and (c) committed conduct unbecoming a licensee within the meaning of section 35(2) of the Real Estate Services Act by: (i) failing to settle the terms of an order of the Supreme Court of British Columbia on a reasonable basis; and (ii) failing to comply with orders of the Supreme Court of British Columbia
Result: Alexander Hart was suspended for sixty (60) days from May 19, 2010 to July 17, 2010 (inclusive) and was ordered to successfully complete the Trading Services Remedial Education Course, and pay enforcement expenses to the Council in the amount of $1,000.00.
