Issue: Lawrence Kwong Inn Wong, associate broker, Royal Pacific Realty (Kingsway) Ltd., Vancouver, entered into a Consent Order with the Council in which he consented to an Order that he committed professional misconduct within the meaning of section 35(1) of the Real Estate Services Act in that he: (a) contrary to section 3-3(1)(a) of the Council Rules, did not act in the best interests of sellers by providing agency to the sellers pursuant to the sellers ’ listing and also considering to act as an agent for the buyer in the proposed resale of the property, as evidenced, in part, by the Authority to Sell; (b) contrary to section 3-3(1)(j) of the Council Rules, failed to disclose to the sellers the conflict of interest set out in paragraph (a) above; and (c) contrary to one or more than one of section 35(1)(d) of the Real Estate Services Act and section 3-3(1)(d) of the Council Rules, failed to fully or properly advise the sellers in writing to seek independent advice when they requested Mr. Wong to terminate the contract.
Result: Lawrence Kwong Inn Wong was suspended for seven (7) days from January 20, 2010 to January 26, 2010 (inclusive) and was ordered to enrol in and attend the first available CPE courses “Real Estate E&O Insurance Legal Update 2009 ” and “What Brokerages and REALTORS ® Need to Know About Agency ”, and pay enforcement expenses to the Council in the amount of $1,000.00.
