Complaint: Contravention of sections 35(1)(a) [professional misconduct] and 35(1)(d) [incompetence] of the Real Estate Services Act  

Issue:   Susan Mae Perrey, formerly known as Susan Mae Perron, representative, Island Homes Realty Corp. dba Island Homes Realty, Ladysmith, committed professional misconduct within the meaning of section 35(1)(a) and section 35(1)(d) of the Real Estate Services Act in that she: (a) undertook to act as a limited dual agent when she was the buyer in the subject transaction, which conflicted with the interests of her client, the said sellers; and (b) failed to make the said Contract of Purchase and Sale subject to the sellers seeking independent advice and/or independent legal advice with respect to the value of the said property and/or the terms and conditions of the said contract.  

Result: Susan Mae Perrey was suspended for seven (7) days from October 22, 2008 to October 28, 2008 (inclusive) for professional misconduct as described above after an Agreed Statement of Facts, Proposed Acceptance of Findings and Waiver was entered into between the Real Estate Council and Susan Mae Perrey, and a Consent Order was issued.   Further, Susan Mae Perrey was ordered to successfully complete the disciplinary assignments applicable to Chapter 2 (The Real Estate Services Act) and Chapter 10 (The Law of Contract) of the Real Estate Trading Services Licensing Course, and to pay enforcement expenses to the Council in the amount of $750.00.
