Complaint: Contravention of section 35(1)(d) [incompetence] of the Real Estate Services Act and section 3-4 [reasonable care and skill] of the Council Rules
Issue: Robert Scott Joiner, representative, Estate Realty Ltd. dba Coldwell Banker Comox Valley, now known as Coldwell Banker Island Coastal, Courtenay, committed professional misconduct within the meaning of section 35(1)(d) of the Real Estate Services Act in that he failed to ensure that the assignment of the contract from JK to JC was properly documented, in accordance with section 3-4 of the Council Rules.
Result: Robert Scott Joiner was suspended for seven (7) days from October 1, 2008 to October 7, 2008 (inclusive) for professional misconduct as described above after an Agreed Statement of Facts, Proposed Acceptance of Findings and Waiver was entered into between the Real Estate Council and Robert Scott Joiner, and a Consent Order was issued. Robert Scott Joiner was also ordered to enroll in and attend the first available CPE Course “Contracts: Keep on Top of Changes ” or “Risk Management for Realtors ”. Further, Robert Scott Joiner and Ronald Illsley Limer were ordered to be jointly and severally liable to pay enforcement expenses to the Council in the amount of $750.00.
