Complaint: Contravention of section 35(1) [professional misconduct] of the Real Estate Services Act and section 5-3 [signing agreements on behalf of clients] of the Council Rules
Issue: Susan Vee-Shui Zee, representative, Royal Pacific Realty Corp., Vancouver, committed professional misconduct within the meaning of section 35(1) of the Real Estate Services Act by contravening section 5-3 of the Council Rules in that she signed an addendum with respect to a Contract of Purchase and Sale of property on behalf of her client, the seller, and in the name of her client, on the verbal instructions of her client but without first obtaining her client ’s written authorization.
Result: Susan Vee-Shui Zee was suspended for seven (7) days from May 28, 2008 to June 3, 2008 (inclusive) for professional misconduct as described above after an Agreed Statement of Facts, Proposed Acceptance of Findings and Waiver was entered into between the Real Estate Council and Susan Vee-Shui Zee, and a Consent Order was issued. Further, Susan Vee-Shui Zee was ordered to pay enforcement expenses to the Council in the amount of $750.00.
