Complaint: Contravention of section 35(1)(a) [professional misconduct] of the Real Estate Services Act and sections 3-3(1)(a)(i) [duties to clients] and 3-4 [duty to act honestly and with reasonable care and skill] of the Council Rules   

Issue:   John Edgar Isaac, representative, Homelife Merritt Real Estate Ltd., Merritt, committed professional misconduct within the meaning of section 35(1)(a) of the Real Estate Services Act by contravening sections 3-3(1)(a)(i) and 3-4 of the Council Rules in that while acting as a limited dual agent in connection with the sale of a residential property he: (a) offered to purchase the property jointly with a business partner without first contacting certain prospective buyers to whom he had earlier provided representation in connection with their attempted purchase of the property to obtain their informed consent to his intended course of action; and (b) represented the seller and his co-buyer of the property in a transaction in which he was a principal.  

Result: John Edgar Isaac was suspended for seven (7) days from May 21, 2008 to May 27, 2008, (inclusive) for professional misconduct as described above after an Agreed Statement of Facts, Proposed Acceptance of Findings and Waiver was entered into between the Real Estate Council and John Edgar Isaac, and a Consent Order was issued.   Further, John Edgar Isaac must successfully complete the disciplinary education assignments applicable to Chapter 2 (The Real Estate Services Act) and Chapter 9 (Professional Ethics) of the Real Estate Trading Services Licensing Course, enroll in and attend the first available CPE course  “What Brokerages and Realtors Need to Know About Agency ” and pay enforcement expenses to the Council in the amount of $750.00.
