Complaint
Breach of Section 38/Misconduct

Issue
Surjit (Allan) Chandhok, currently unlicensed who, while licensed as a salesperson with Sutton Centre Realty, Burnaby, misconducted himself in respect of multiple transactions in that he:

(i)   did not provide a disclosure in writing in the form and manner prescribed by the Superintendent to the prospective owners of the real estate, which would include the registered owner and/or the assignor of an interest as buyer under a Contract of Purchase and Sale to Surjit (Allan) Chandhok or a company of which he was sole director and officer as assignee; and,

(ii)   did not have the Notice and Disclosure documents signed by his nominee and did not have the Notice and Disclosure documents forwarded to the Real Estate Council.

Penalty
No application for relicensing will be considered from Mr. Chandhok by the Council for a period of twelve (12) months commencing from February 5, 2004, which was the day he surrendered his licence to the Council, in accordance with an Agreed Statement of Facts, Proposed Acceptance of Findings and Waiver was entered into between the Real Estate Council and Mr. Chandhok resulting in a Consent Order being issued.   In addition, as a condition of relicensing, he is required to successfully complete Chapter 2 (The Real Estate Act and The Code of Ethics and Standards of Business Practice) and Chapter 9 (Code of Ethics) of the Real Estate Salesperson ’s Pre-Licensing Course.   Also as a condition of relicensing, Mr. Chandhok was ordered to pay costs in the amount of $3,875.
